Modelo 720: declaring your assets abroad once you live in Spain

If you are a Spanish tax resident and hold more than €50,000 in any one category of assets outside Spain, you must declare them on Modelo 720 by 31 March of the following year.[1] Since Europe’s top court struck down Spain’s punitive fines in January 2022, Modelo 720 has become an administrative chore, not a catastrophe, provided you still file it.[2] You file with the Agencia Tributaria, Spain’s tax authority. The form reports what you hold abroad. It does not tax you for holding it.

Who has to file Modelo 720?

The obligation follows tax residence. Owning a Spanish home does not create it on its own. You are generally resident if you spend more than 183 days in Spain in a calendar year, or if your main economic interests are based here.[1] Renting while you settle in does not exempt you once you have passed that 183-day mark.

If you are not sure whether you have crossed into residence, that is exactly what a qualified adviser is there to resolve. Residence can be genuinely borderline in your first year, and the test weighs your family and economic centre as well as the day count. An asesor fiscal, a Spanish tax adviser, confirms it before you file, rather than leaving you to guess.

What counts: accounts, investments and property abroad

Modelo 720 has three reporting categories. Each carries its own €50,000 threshold, measured on the total you hold in that category:[1]

  • Bank accounts held outside Spain.
  • Securities, investments, life assurance and pensions held abroad.
  • Real estate held outside Spain.

You report a category only once its combined balance passes €50,000. Triviality is a feeling, not a legal test. A balance in Revolut or Wise counts the same as one in a high-street bank, and a tax-free account at home, such as a UK ISA, is not exempt just because it feels informal.[1] For Northern European readers, accounts and pensions across the EU and the UK all count the same way. A small current account in one country plus a workplace pension in another can push a category over the line together.

How the 2022 EU court ruling changed the penalties

This part still frightens people, usually with out-of-date stories. Before 2022, late or incorrect filing could trigger fines worth more than the undeclared assets themselves, and the income could be taxed with no time limit. On 27 January 2022 the Court of Justice of the European Union, in case C-788/19, ruled that regime disproportionate and in breach of the free movement of capital.[2] Spain had to abolish those penalties.

The forum stories about people fined more than their assets were worth describe the old system. It no longer applies. Late or incorrect filing now falls under Spain’s ordinary tax penalties, which are far milder and time-limited.[2] The form still matters. What once made it dangerous is gone.

When is the deadline, and do I file every year?

You file for the first time for any calendar year in which a category crossed €50,000. The deadline is 31 March of the following year.[3] In October 2026, the next declaration covers your 2026 assets and is due by 31 March 2027.

After that first filing, you do not re-file every year by default. You file again only if a declared category has risen by more than €20,000 since your last declaration, or if you have closed an account or sold an asset you previously reported.[3] If nothing much has changed, you leave it until something does.

Getting it right the first time

If you think you are, or are about to become, a Spanish tax resident, you can start now. Add up what you hold in each of the three categories and see whether any one tops €50,000. Gather your account statements, investment and pension valuations, and any registry document for property you own abroad.

From there it comes down to this: understand your obligation, note the 31 March deadline, and confirm the details with a qualified cross-border tax adviser before filing.
